1. General
- (a) The information contained on the website (https://www.coldfeetadventure.com/) and/or
provided to you directly by the representatives of Cold Feet Adventure is intended to be a
fair and proper representation of the prevailing conditions and circumstances. At the same
time, it states that both parties can provide a bit of flexibility and adaptability to these
terms.

(b) Before the start of service whether the main one or additional (supplementary) one,
both parties must, first, mutually agree to the trip price.

2. Payments:
- (a) A deposit is mandatory once the contracting parties have agreed upon the terms and
conditions as stated in the contract, and a booking has been secured by signing on this
contract.
- (b) The receipt of the deposit payment acts as evidence to secure the booking.
- (c) The remaining amount of the cost of goods and services must be paid by the client
before the departure date of the first service.

3. Price Guarantee:
Once the deposit has been paid by the client, the price of the services shall be as mentioned
in the contract.

4. Cancellation/Curtailment/Postponement:
- (a) The deposit amount is non-refundable; however, in cases where the trip is canceled due
to actions caused by Cold Feet Adventure, the deposit amount shall be refunded in full.
- (b) In cancellation of any event or trip by Cold Feet Adventure, the full amount already paid
shall be a subject to refund.
- (c) In case the trip is canceled by the client/s, the paid deposit amount shall not be
refunded.
- (d) In case the client postpones the event after paying the deposit, 50% of the deposit can
be collected within 12 months since the date when the postponement notice is provided.
The amount of the original price of service initially agreed will be reviewed.
- (e) If at any time before the start of service date, the client/s wishes to alter the originally
agreed program, there will not be any penalty associated with the altered
services/dates/prices. However, change must be feasible and available.
- (f) The refund will not be provided once the agreed program starts. If there occur
circumstances where the client wants to take a refund, then the client will have to contact
his/her insurance company.
- (g) Any consideration will be made by Cold Feet Adventure by gaining the approval of the
director of Cold Feet Adventure; but, only under very rare circumstances.

5. Legal Compliance:
It is presumed that the client agrees to act as per the necessary rules and regulations
governing visas, immigration, customs, and foreign exchange regulations. If there appear
circumstances in which it appears that the client has acted against the prevailing rules and
regulations of the traveling country, Cold Feet Adventure has the right to cancel the
trip/program without any option of a refund.

6. Travel Insurance & Emergency Details:
Cold Feet Adventure recommends its client/s to obtain the appropriate Travel Insurance which covers all the medical and travel issues of the client for the duration of the trip. The client must be aware that his/her travel insurance will cover his/her needs on the trip.
- (a) The client/s must submit a photocopy of his travel insurance to Cold Feet Adventure.
- (b) The client/s must provide an emergency contact number (next to kin) to Cold Feet Adventure in case of emergency situations.

7. Dispute/ Claim Resolution:
In cases where a client makes a claim against Cold Feet Adventure, the client must notify the management of Cold Feet Adventure as early as possible. If the claim is for compensation, then it is advised that the matter be solved while the client/s remains in Nepal, and effort should be made to make this happen. In cases where the matter is not solved during the client/s stay in Nepal either due to ongoing legal process or court hearings, then both parties need to agree on a resolution process before going forward. The terms and criteria of the settlement should be recorded. As a last alternative, any unresolved subject matter is referred to as the prevailing and applicable Nepalese Law.

8. Contractual Commitment:
Once the deposit has been paid, the terms of the contract shall be legally binding on both the contracting parties. As such, Cold Feet Adventure must honor the Client/s Assumption of Risk and Guarantee.

Client/s Assumption of Risk and Guarantee:
The client/s should be aware that the trek, expedition, whitewater rafting trip, jungle safari, or any other trip under the arrangement of Cold Feet Adventure Pvt. Ltd. and its subsidiaries, associates, or agents, include a certain degree of risk and danger which may be exceptional in comparison to the client/s everyday activities. The client must assume the risk involved while signing the contract. The activities which comprise risk mostly comprise of:
- Traveling in mountainous terrain, crossing rivers, traversing the forests.
- Traveling by aircraft, car, coach, jeep, boat, raft, elephant, donkey, bicycle, and any other means of transport.
- Accidents caused by natural forces.
- Accidents or illness in remote villages with very little medical facilities and without means of fast communication or evacuation.

Changes in the itinerary due to reasons beyond the control of Cold Feet Adventure.
In consideration of the above mentioned terms and conditions and as per the right of the client to participate in trips and services arranged by Cold Feet Adventure and its subsidiaries, associates, agents and employees, I/We assume all the above mentioned risks and will not hold Cold Feet Adventure culpable against any and all liabilities, actions, suits, debts, demands, and any sort of claims irrespective of kind and nature which may arise in connection with the trip or participation in activities arranged by the aforementioned company and its subsidiaries, associates, and agents. This agreement serves as a legal document and as my stated assumption of risk and as a guarantee by myself on behalf of myself and my heirs, administrators, executors, and all members of my family including any minors whether accompanying me or not.

Payment Terms
Payment
A deposit is needed to make the booking official. The final balance becomes due two months before the trip start date. Full payment is to be made within 7 days before the departure date. In circumstances where the full payment cannot be made, the trip will be canceled.
Cancellations
The bookings can be canceled and the amount paid will be refunded accordingly if these terms are fulfilled:
- Bookings canceled two months or more before departure: refund of 100% of trip cost
- Bookings canceled two months or less before departure: refund of 0% of trip cost

Previous Terms - Before 08/07/2019
The above-mentioned terms are applicable for bookings before 08/07/2019. For refunds, you can receive 100% amount (minus deposit) for more than 120 days before the departure. You can receive 75% of the refunded amount (minus deposit) for a time frame of 120-90 days before departure. A refund of 50% (minus deposit) can be claimed for a time frame of 90-60 days before departure. A refund of 25% (minus deposit) can be claimed for a time frame of 60-30 days before departure. The amount will be non-refundable after the time frame of 30 days before departure.
